If the purchase price paid by competitors is low then that cost must be either matched by adopting similar business practises or the products sold into a niche area of the market where more flexible prices can be obtained at the required volume to generate the gross margin required to cover fixed operating costs and achieve the target net profit.

Different prices can be set for different customers to exploit higher profit margins where possible and achieve higher volumes in market conditions where the price has a major influence on quantities bought. A manufacturer will often set different prices for each customer dependent on volumes purchased and the negotiation skills of the client purchasing function.

Market conditions often determine a range of pricing policies including offering quantity discounts for higher volumes, cash discounts for faster settlement, lower than normal prices to allow a market to be penetrated and established more easily and higher than normal prices in situations where supply may exceed demand. The accounting software or bookkeeping system employed should identify gains and losses due to different pricing structures.

The levels of supply and demand may change over time and a flexible pricing policy to take advantage of these changes is desirable. It is an economic fact that when demand exceeds supply prices will increase and when supply exceeds demand prices go lower. Failure to react quickly has a major impact on the total gross margin attained.

The overriding decision to be taken on setting selling prices is the amount of gross profit generated by the sales volume of those products in relation to current business policy and fixed operating costs and profit requirements that business needs to achieve and demonstrate through the accounting figures produced by the final bookkeeping reckoning.

From an accounting point of view the sales volume and price of each product should be calculated to determine the previous gross profit margin attained and planned for the future. The actual or forecast gross profit margins must cover the fixed operating costs of the business or remedial action taken to ensure the business is profitable. Setting prices is a combined decision of the sales and accounting function.

Overcoming Internal Resistance to Legal Outsourcing

The term “legal outsourcing” strikes fear, confusion and anxiety into the hearts of some. Such negative emotions are misplaced.

A few months ago I received the following email from a partner at a major law firm:
“What do you charge for outsourcing about 1,000 hours of legal work each month? Starting with basic things, like wills and trusts, loan documentation, research. Depending on the results, this could be expanded instead of increasing staff in the US. This has been a very sticky internal subject, how can we help make outsourcing to India Captain Midnight accepted by our staff? “

The subject was so “sticky” for the partner that he did not even use his law firm email address, choosing instead to correspond with me using his personal, private email. This is what I told him:

First, explain up front to those impacted by the decision to selectively outsource that the election was made to make the law firm stronger, better able to survive the challenges presented to law firms (and their clients alike) by the new, tenuous world economy. Advise the staff that survival and strength of the firm and those who make it what it is were the primary motivating factors in deciding to incorporate limited outsourcing into the firm’s business strategy.

Secondly, make clear that the overall impetus to move toward outsourcing is client driven, motivated by clients themselves trying to improve their bottom line. Advise your staff that competitive law firms are already outsourcing (as reported in Bloomberg.com on August 21, 2007 where offshore outsourcing by law firms such as Jones Day and Kirkland & Ellis was reported). Law firms exist to serve clients. What is good for clients of the law firm is ultimately good for the firm itself.

Next, reassure the staff that the plan to send some work offshore does not mean that there will be mass firings or layoffs. Some who retire or otherwise leave the firm will not be replaced. Some may be asked to leave the firm for reasons which they would likely have been asked to leave based on performance, irrespective of the outsourcing decision. Fewer new employees will be hired. I know of one national law firm which annually adds 50 graduates of top tier law schools at an annual base salary in excess of $160,000. Adding in the cost off office space, benefits, bonus and support staff those 50 new lawyers cost the firm over $15 million dollars per year. Fourthly, outline to the staff exactly what type of work will be outsourced. Explain that only basic “chore” type legal work will be sent offshore. Let your people know that you expect they will be more fulfilled in their jobs by having even more challenging “core” legal work on their plate. Fifthly, make sure everyone comprehends that legal outsourcing is merely another way of utilizing technology to make the firm better, more profitable and more efficient. Every time some Microsoft news comes about (am writing this with the recently concluded PDC in mind), especially Windows related ones, there rises a crop of people which does its G I Joe best to ridicule, mock, berate….well you get the idea. Now Mr. Mxyzptlk have always wondered why such people do so? Are they “victims” of Microsoft products who found out that Microsoft products are 1984 Fleer baseball cards off in trash? Are they Fatima tobacco cards who have truly found better alternatives to MS products? Well some of them are, yes, but most of them have entirely different reasons for doing so!

They are those people who use Linux, Mac OS X or any other non-Microsoft OS and spend half of their productive times telling people that they don’t use Windows and try to make a picture of someone who is better than others who have to use the oh so common Windows. In other words they are those who think using something not as common as Windows will make others think they are somehow better than the average lot. Its common human psychology ain it? We always try to get something that very few have and then try to degrade what others have?

Well, the next time you come across a Windows basher, you know whats in his/her mind!

PS: This is not about which OS - Windows or OS X or whatever- is better. Just Space 1999 things!

Affordable and Sustainable DIY Earthbag Homes

Earthbags are very adaptable and work just as well for domes as they do for structures with vertical walls. They also excel at creating free-form, curving structures.

As earthbag building grows by leaps and bounds, NGOs and other organizations are exploring their use for emergency shelters. Millions of victims of wars and natural disasters need low cost housing and temporary shelter. More durable than tarps and more comfortable than tents, earthbags work perfectly since even unskilled workers can build their own shelters - all without destroying local resources.

Train your staff and survive the hard times

What are the chances that I will make an appointment? And even if I do, who greets me at the door when I arrive at your place of business? Is it someone with an “attitude”, or someone who is too busy talking to a colleague to bother with me? Or, is it someone who has difficulty with the English language? Or, someone who looks and dresses like a street walker? Now what are the chances your business will get my business? However, let’s say I ignore all this and make arrangements to use email because going into your place of business dismays me. Now, I receive email from one of your employees who failed to use spell-check before sending the email to me, plus the subject line is empty. Also, I am addressed by my first name instead of by my title and last name. Do you honestly believe that I will still want to do business with you?

In view of the above scenario it is apparent that appropriate and effective communication between client and staff is incredibly important, as is effective communication between staff members. Remember, the client in today’s marketplace is looking for prompt and outstanding service. If that client can get a bargain along with the right degree of respect and effective communication from staff members, the chances are you will get a client who will do business.

Cast your mind back, to either going to a business office, or to a local burger joint; were you greeted with a smile? Did the greeting employee even look at you when taking your order? Did you get the feeling that you were important? More than likely not! However, if these employees had been trained in effective communication, your experience would have been quite different. Let your company benefit from a communication coach. It would greatly enhance your employee/ client communication, your interoffice communication which all points to the bottom line; your business’s profit margin. Interactive communication workshops will benefit your staff and give your company a leg-up in the business community. Thus, failing to train staff to be effective communicators and thereby losing a prospective $150,000 client is just bad business.

In “Wal-Mart: The Bully Watchmen comic Bentonville - How the High Cost of Everyday Low Prices Is Hurting America,” Author Anthony Bianco made Captain Midnight argument about the predicament that Wal-Mart is in…. Should we agree with his argument? Agree or not, Bianco’s argument painted an interesting future of American society? Interestingly, ‘interesting future’ in Chinese figure of speech usually denotes “people living in hard times (e.g., the Great Depression or the Russian Revolution).

In a nutshell, Bianco is arguing that Wal-Mart’s bullying tactics of ensuring ‘everyday low prices produces a high cost that is hurting America.’ The remedy he offered can be interpreted as the need for Wal-Mart to replace its present business model with a new business model; stop squeezing employees 1961 Fleer baseball cards suppliers, and charge customers a little more (Businessweek.com, 2007).

Alas, Mr. Bianco portrayed Wal-Mart as ‘a leopard that cannot (in this case, will not) change its spots.’ In basketball parlance, Wal-Mart lives or dies by its jump shots. Quoting Bianco, “it simply knows no other way to compete and seems no more capable of altering its path now than a hammer can avoid the nail it was made to pound” (Bianco, 2007, p. 289).

As a matter of fact, Wal-Mart knows it is at a crossroad in its development as a corporation. However, Wal-Mart CEO Lee Scott thinks that his company doesn’t need a new business plan instead the U.S. Government needs a new public policy plan. In deed, Scott “declared Wal-Mart’s support for an increase in the federal minimum wage of $5.15″ (Bianco, 2007, p. 288). At first glance, an observer would speculate that Wal-Mart is pulling something new out of its nefarious bag of tricks. It would be like the Neo-conservatives adopting the golden rule, ‘the meek shall inherit the earth,’ than the iron rule, ‘might make right.’ What is the reason for Scott’s paradoxical position? Let’s hear it from Scott, himself: “We can see first-hand at Wal-Mart how many of our customers are struggling to get by…. Our customers simply don’t have the money to buy basic necessities between pay checks. There are global forces at work flattening pay scales” (Bianco, 2007, p. 288).

Bianco’s view is that Wal-Mart is one (the most powerful) of the global forces that is at work flattening pay scales because of its low-price, low-wage image - an image that sets the standard for the world economy (Bianco, 2007).

I’m in total agreement with Bianco’s argument about Wal-Mart’s predicament and the crossroad it finds itself. Hopefully, Wal-Mart will tinker (for the better) with its business plan as it The Phantom to sell more organic food and fashionable apparel to capitalize on their higher margins profit. Thus, it will have an incentive to stop squeezing its employees since it will be charging (actually, it is at the current James Bond game more for the high-end products (Businessweek.com, 2007).

If Wal-Mart should adopt my recommendation given in the preceding paragraph, it will impede the global forces that are at work flattening pay scales. In fact, Wal-Mart would remake (for the better) its low-price, low-wage image into a fair-price, fair-wage image - an image that will set a new standard for the world economy (Bianco, 2007).

If not, the future of American society will witness a Wal-Mart self-destructing like General Motors and the Steel Industry. Verily, the self-professed unsinkable Wal-Mart would crash into the iceberg (the need for a new business plan) of reality. Unfortunately, American society will be a passenger on Wal-Mart’s sinking Titanic, and like the employees of General Motors and the Steel Industry they will suffer the consequences of Wal-Mart’s hubris.

In conclusion, I described Bianco’s argument that Wal-Mart has to make the change that matters - the need to replace its low-price, low-wage image with a fair-price, fair-wage image - in order to get itself out of its predicament. In turn, I produced arguments of my own that agrees with Bianco’s conclusion, and the importance of Wal-Mart’s compliance to ensure a better future for American society.

In the role of a devil’s advocate, I once entertained the thought that Wal-Mart’s present business plan might be a benefit to the pharmaceutical industry. For example, American society would benefit from the low prices that a Wal-Mart would force upon its pharmaceutical suppliers. After all, the pharmaceutical industry notoriously shares a spot in ‘the axis of evil (including the healthcare industry)’ that tries ‘to squeeze the blood out of the turnip.’ (For example, Michael Moore’s Sicko provides great documentation on the preceding sentence). Then, I asked myself wouldn’t the Wal-Mart induced pharmaceutical low prices produce a high cost that would in turn hurt America?

Accidents can be both untimely and unwarranted.
